Trump's Occupational Safety and Health Administration is moving to scrap medical checks for millions of workers who wear N95-style respirators and to loosen respirator rules for workers exposed to lead. On Oct. 28, more than two dozen congressional Democrats told the agency to stop.

"OSHA now seems to be moving rapidly to finalize the removal of critical respiratory protections," Sen. Elizabeth Warren (D-Mass.) and Rep. Ilhan Omar (D-Minn.) wrote, with colleagues, in a [letter](https://www.warren.senate.gov/wp-content/uploads/2026/10/2026.10.28-Letter-to-OSHA-on-respirator-rule.pdf?ref=workersrights.news) to David Keeling, the assistant secretary of labor who runs OSHA. They asked him to "abandon these rulemakings."

## What OSHA wants to change

**Medical evaluations.** Today, before a worker can be required to wear a respirator, the employer has to provide a medical evaluation, usually a questionnaire and sometimes an exam, to confirm the worker can safely breathe through it. OSHA's [proposed rule](https://www.govinfo.gov/content/pkg/FR-2025-07-01/html/2025-12235.htm?ref=workersrights.news), published July 1, 2025, would drop that requirement for filtering facepiece respirators such as N95s and for loose-fitting powered air-purifying respirators. Fit testing and training would stay.

OSHA's own estimate: 2,733,069 private-sector employees use those two types of respirators. Each year, about 1.2 million medical questionnaires and about 252,000 follow-up exams would no longer be required.

**Lead.** A [separate proposal](https://downloads.regulations.gov/OSHA-2025-0022-0002/content.html?ref=workersrights.news) would let employers, in some situations, hand workers exposed to lead a half-mask respirator with eye protection instead of a full-facepiece respirator. It would also drop the rule that lead respirators use high-efficiency (HEPA) filters. OSHA said the change "would not substantially modify existing requirements" and estimated employers would save about $23 million a year if half of exposed workers switched to half masks.

The lawmakers' letter says OSHA's proposals would also weaken respirator requirements for asbestos, formaldehyde and inorganic arsenic. The letter puts the changes among more than 60 deregulatory actions the agency has taken since July 2025.

## Who's objecting

It isn't only Democrats. The Associated General Contractors of America, the construction industry's trade group, [urged OSHA to withdraw](https://news.agc.org/safety-health/agc-opposes-osha-proposal-to-roll-back-lead-respirator-protections/?ref=workersrights.news) the change that would drop the full-facepiece requirement for lead.

OSHA's own Advisory Committee on Construction Safety and Health also pushed back. At a May 2026 meeting, the committee unanimously opposed removing the HEPA filter requirements for asbestos, cadmium, lead and inorganic arsenic, according to an account by the law firm [Jenner & Block](https://environblog.jenner.com/2026/05/21/osha-advisory-committee-raises-concerns-over-agencys-respirator-standard-overhaul/?ref=workersrights.news). The lawmakers wrote that the committee "recommended that you not proceed with this rulemaking."

"Unions, medical professionals, and industry experts have cautioned you against removing this requirement," the letter says.

## Where it stands

OSHA took comments on the proposals in 2025, reopened the record on the medical-evaluation rule in June 2026, and held a hearing in August, according to the letter. No final rule has been published. The Labor Department had not publicly responded to the letter as of Friday, [International Business Times reported](https://www.ibtimes.co.uk/osha-asbestos-lead-respirator-rule-changes-1829123?ref=workersrights.news).

Respirator rules exist because the air in some jobs can kill: lead dust on a demolition site, asbestos in an old building, chemical fumes in a plant. Cutting the checks that make sure a worker can safely wear the mask saves employers paperwork and shifts the risk to the person wearing it. We oppose this rollback.

**If you wear a respirator at work,** the current rules still apply. Your employer must provide a medical evaluation, fit testing and training before requiring you to use one. If it doesn't, you can [file a complaint with OSHA](https://www.osha.gov/workers/file-complaint?ref=workersrights.news), and the law bars your employer from retaliating against you for it.
