The NAACP sued the Justice Department on Friday to stop its plan to send about 1,000 federal monitors to polling places for the Nov. 3 midterms. The group says the plan is designed to intimidate voters.

The complaint, filed Oct. 16 in federal court in Washington, D.C. (*NAACP v. Blanche*, No. 1:26-cv-03626), names Attorney General Todd Blanche, Assistant Attorney General for Civil Rights Harmeet Dhillon, and the department. "There is no federal statute that gives Defendants the authority to turn polling places into interrogation rooms," the complaint says.

### What the lawsuit claims

The main claim rests on Section 11(b) of the Voting Rights Act, which says no person, "whether acting under color of law or otherwise," may intimidate, threaten, or coerce anyone for voting or trying to vote ([52 U.S.C. § 10307(b)](https://www.law.cornell.edu/uscode/text/52/10307?ref=workersrights.news)). "Under color of law" means acting with government authority, so the ban reaches federal officials too. A second claim says the department violated the Administrative Procedure Act when it rescinded its Federal Prosecution of Election Offenses policy.

The NAACP wants a judge to bar the department from using criminal prosecutors and law enforcement agents as monitors, and from using monitors to challenge voters' eligibility or limit access to voting sites.

### Why the NAACP says this year is different

Dhillon has called the effort "the biggest DOJ election observer effort in history," and Blanche said on Oct. 4 that "a thousand or more" monitors would go to "every state," according to the complaint. The complaint says the department has never sent more than 600 before.

It also points to Wyoming's August primary, where Republican Gov. Mark Gordon called the conduct of federal monitors "aggressive" and "irregular" after they arrived unannounced and asked to examine vote tabulators. The department disputes that its monitors acted improperly in Wyoming. A spokesperson told the Guardian that monitors follow legal and ethical rules, including not interfering with voting, and Blanche has defended the plan on Fox News: "Since the 60s, the Department of Justice has monitored elections."

This is the NAACP's second lawsuit over the plan. Earlier this month it sued for records on where the monitors will go; the department opposed the group's request for an emergency order on Oct. 13\. No hearing had been set in the new case as of Friday night.
