# Democrats win the Senate and full control of Congress. Incoming Oversight chair to Trump's circle: 'Lawyer up.'

Democrats have won control of the U.S. Senate, NBC News, ABC News and CNBC's Election Desk projected late Tuesday night, giving the party both chambers of Congress for the rest of President Trump's term.

The Senate majority came together through six projected flips of Republican-held seats, all called by the AP, [CNBC reported](https://www.cnbc.com/2026/11/03/midterm-elections-2026-live-updates.html?ref=workersrights.news): Josh Turek beat Rep. Ashley Hinson in Iowa, Adam Hamilton unseated Sen. Roger Marshall in Kansas, Roy Cooper beat Michael Whatley in North Carolina, Sherrod Brown unseated Sen. Jon Husted in Ohio, Annie Andrews unseated Sen. Darline Graham in South Carolina, and James Talarico beat Ken Paxton in Texas. CNBC projects Democrats will hold at least 51 seats, the minimum for control, since Vice President JD Vance breaks ties. Some races, including Maine, were still being counted.

### "Lawyer up"

Rep. Robert Garcia, D-Calif., who is expected to chair the House Oversight Committee, posted a two-word message on X as the results came in: "LAWYER UP," [NBC News reported](https://www.nbcnews.com/politics/2026-election/live-blog/midterm-election-results-2026-news-trump-live-updates-rcna605763?ref=workersrights.news). CNBC described it as a warning to the Trump family, DHS and ICE.

Garcia's office said he has vowed to take on what it called the "Trump Crime Family," along with corporate corruption, abuses at DHS and ICE, and the handling of the Epstein files, according to CNBC. In the minority, Democrats couldn't issue subpoenas or schedule oversight hearings. That changes when the new Congress convenes in January, [NBC reported](https://www.nbcnews.com/politics/2026-election/democrats-capture-full-control-congress-nbc-news-projects-fueled-victo-rcna607042?ref=workersrights.news).

### What changes for working people

A Democratic Senate decides which of Trump's nominees get a floor vote, including judges and the officials who run the agencies that enforce labor law. Sen. Richard Blumenthal, D-Conn., put the odds that Democrats would back a nominee from this administration at "slim to none," NBC reported.

"Relief is on the way," said Senate Democratic Leader Chuck Schumer, who also told Republicans to "listen to the American people."

Trump told Fox News he was "a little bit surprised" and "thought we'd do better," NBC reported. He told The New York Times he is "absolutely willing" to accept the results.

### What's next

Republicans still control both chambers until Jan. 3 and could try to pass a party-line bill and a debt ceiling increase in the lame-duck session, NBC reported. Senate Democrats are expected to pick Schumer as leader again, and House Democrats choose their speaker nominee the week of Nov. 16.
