- Description: What to do if a poll worker says you're not on the list, and when your boss owes you time off to vote.

You don't have to break a law to get treated like a suspect at the polls. You just have to land on a list the government distrusts, or file a form nobody processed. Two lawsuits this month show both routes.

On Oct. 15, the League of Women Voters, the Electronic Privacy Information Center, and the League of United Latin American Citizens sued the Department of Homeland Security in federal court in Washington, D.C. Their complaint alleges DHS "has obtained and is processing voter files from at least 47 states" and runs an "Unlawful Voter Initiative" that checks those files against immigration databases. ([We covered the lawsuit here.](https://www.workersrights.news/dhs-voter-data-47-states-lawsuit/))

In Texas, the League of Women Voters of Texas and MOVE Texas Civic Fund sued the Department of Public Safety and the Secretary of State's office in state court in Bexar County. They say more than 500,000 registrations submitted through the DPS website since October 2025 were never processed, Votebeat and The Texas Tribune reported. Those people did everything right.

Election Day is Tuesday, Nov. 3, and early voting is underway in many states. Check your registration now, while you can still fix it.

### DHS's "unlawful voters" kept turning out to be voters

According to the complaint, DHS identified 185 people in Nevada as possible noncitizen voters, and Nevada officials found all 185 were U.S. citizens. The lawsuit doesn't claim DHS has removed anyone from the rolls. It does show how bad data with a federal seal ends up aimed at real voters, with naturalized citizens in the crosshairs.

We condemn this program. Turning voter files into an immigration watch list tells eligible citizens their ballot comes with an investigation attached.

### Five minutes on vote.gov beats an hour at the check-in table

Go to [vote.gov](https://vote.gov/?ref=workersrights.news) and pick your state; it points you to the official registration lookup. Search your name the way it appears on your ID and confirm your address. If you've moved or changed your name since you last voted, assume your record is stale until you see otherwise.

If you're missing or the details are wrong, call your county elections office this week.

### Told you're not on the list? Ask for a provisional ballot.

Federal law covers this. Under the Help America Vote Act ([52 U.S.C. 21082](https://www.law.cornell.edu/uscode/text/52/21082?ref=workersrights.news)), if your name isn't on the polling place list, or an official says you aren't eligible, you can still cast a provisional ballot. You sign a statement that you're registered there and eligible to vote. The poll worker has to tell you this option exists. Translation: they can't just send you home.

Election officials then check, and if you're eligible under state law, the ballot counts. You also get written information on how to find out, through a free hotline or website, whether your vote counted and, if not, why. Keep that paper.

Also ask whether you're at the right polling place. State law decides whether a provisional ballot cast at the wrong one counts.

### Some states let you register on Election Day

According to the [National Conference of State Legislatures](https://www.ncsl.org/elections-and-campaigns/same-day-voter-registration?ref=workersrights.news), 24 states and D.C. offer same-day or Election Day registration. In 21 of those states and D.C., you can do it on Election Day itself. California is on the list. Its version, conditional voter registration, runs from 14 days before an election through Election Day; you vote a provisional ballot that's processed once your registration is verified.

### Your boss may owe you time off to vote

No federal law makes employers give you time off to vote. Some states do, and the rules vary. Two examples:

- **California:** If you don't have enough time outside work to vote in a statewide election, you can take enough time off to vote, and up to two hours of it must be paid. The time comes at the start or end of your shift unless you and your employer agree otherwise. If you know by the third working day before the election that you'll need it, give at least two working days' notice ([Elections Code 14000](https://law.justia.com/codes/california/code-elec/division-14/chapter-1/section-14000?ref=workersrights.news)). For a Monday-to-Friday worker, that means telling your boss by Thursday, Oct. 29.
- **New York:** Without four straight hours to vote before or after your shift while polls are open, you can take time off, up to two hours paid. You must notify your employer between 10 and two working days before Election Day ([Election Law 3-110](https://www.nysenate.gov/legislation/laws/ELN/3-110?ref=workersrights.news)).

Elsewhere, check with your state elections office, and put your request in writing.

### Do it tonight

Check your registration, screenshot it, and put your voting time on the calendar. If something's wrong at the polls, call the nonpartisan Election Protection hotline at 866-OUR-VOTE (866-687-8683), run by the Lawyers' Committee for Civil Rights Under Law. Then go vote.
